Being stopped by a traffic officer or policeman/woman can be an intimidating event, more especially in light of the fact that corruption and extortion is rife in the field of road traffic law enforcement. Corrupt and abusive officials rely on the fact that most road traffic stops occur in an isolated environment where they can intimidate motorists into paying bribes, under threat of dire consequences if they don’t. Completion of AARTO forms
The Administrative Adjudication of Road Traffic Offences (AARTO) Act prescribes forms which must be used in order to take action when an infringement notice is issued to an individual or the registered owner of a vehicle. Completing these forms can be a daunting task and using the incorrect form and/or failing to provide valid legal arguments when, for example, making representation can have devastating consequences. Written representations to traffic authorities and/or public prosecutors
Unlike the AARTO Act, the Criminal Procedure Act does not incorporate prescribed forms for members of the public to use when making written representation to traffic authorities and/or public prosecutors. AARTO administrator training
The Administrative Adjudication of Road Traffic Offences (AARTO) Act brings with it a number of legislated, prescribed procedures which must be followed in order to successfully deal with what is popularly termed “traffic fines”. Individuals, companies and fleet administrators who do not follow these procedures will find themselves falling foul of the provisions of the AARTO Act. Fleet owners who make company vehicles available to their staff members run the risk of their employees falling foul of the provisions of the AARTO Act, more especially when it comes to the points-demerit system and despite the fact that the points-demerit system has not yet been implemented, addressing the behaviour of drivers ahead of the points-demerit system is a very good idea.
